This is the third of three articles dealing with aspects of the 1982 Convention On The Law Of The Sea. This article discusses the evolution of the concept of the Exclusive Economic Zone, its basic principles and legal status. The article also discusses the conservation, management and exploitation of the fishing resources in the EEZ. The negotiating process leading to the adoption of the provisions in the convention relating to the EEZ is also discussed.

This article discusses s. 106 of Singapore's Women's Charter which gives the courts power to order the division of matrimonial assets when granting a decree of divorce, judicial separation or nullity of marriage. The legislative history of this provision is traced and the language analysed with a view to discovering some guidelines for the exercise of the judicial discretion under the section. The existing case law is reviewed and the article concludes with a discussion of the possibility of replacing the discretionary scheme of s. 106 with more detailed provisions setting out with precision the principles to be applied to the distribution of property on divorce.

|Automated Teller Machines and Electronic Funds Transfers at Point of Sale: Selected Legal Issues|

The advent of computer technology has made banking more convenient to the consumer. As in the case of many other financial centres in the world, computer technology has been introduced in Singapore. The government is encouraging the use of electronic transfer of funds as it cuts back on paperwork and is perceived to be more productive. Such technology, as it relates to consumer banking, finds expression in the form of automated teller machines (ATMs), electronic funds transfer at the point of sale (EFTPOS), GIRO systems and home telephone banking. This article discusses some legal issues arising from the use of ATMs and EFTPOS and approaches them from the viewpoint of the bank and its cardholder.

|Jurisdiction to Award Equitable Damages in Singapore|

This article considers whether there is a jurisdiction to award damages in equity in Singapore. It argues that despite a recent case that seems to decide the contrary, it is still possible to argue that there is such a jurisdiction. But in the interests of certainty, it is suggested that there should be legislation to confirm the jurisdiction.

|Probation in Singapore|

This article explores the prospects if using probation as a dispositionary device to alleviate the conflicts that individuals encounter due to poor adaptation to institutional circumscriptions and societal norms. An effort is made in this article to provide a conceptual framework that could be used for implementing the provisions of the Probation of Offenders Act of Singapore and other statutes that provide for supervision by probation officers. It is also indicated in this article that if probation is to be an effective non-custodial disposition in the future, it will have to fulfil goals that extend beyond the objectives traditionally ascribed to custodial and non-custodial sanctions.
