Course Description:
The emphasis will be on the international and comparative aspects of the subject, including:

  • the international treaties in this area (Paris Convention; TRIPs; Madrid etc) and regional developments (eg. the Community trade mark system in Europe; the harmonization efforts in ASEAN;)

  • the inter-relationship between trade mark law and the law of unfair competition in civil law jurisdictions;

  • different treatment by countries of topics such as parallel importation, 'use as a mark' as protection requirement, and protection of geographical indications.
